Children are sitting on the floor of the vehicle and children that are sitting in the seats are not buckling up due to many children per row of the seats. There are too many children being transported that the van can safely transport at one time.

We will ensure that every child is in a seat belt and ensure no more than 10 kids in the van at a time.

340:110-3-400(q)(7)(C) - Child passengers remain properly secured in child passenger restraint system, such as a booster seat or an individual seat belt in compliance with applicable state laws, unless the vehicle is exempt, per (E) of this paragraph. Children or youth do not share a seat belt.

Additional Non-Compliance Found During Investigation: Serious - Supervision - Personnel were not aware of children's activities and not near enough to intervene when needed.
Plan to Correct
The chair which caused the blind spot between the changing table and the bathroom has been repositioned as well as the changing table. The staff has been informed that the bathroom door is to always remain closed. The staff member has been informed that her eyes need to be on all children at all times. The director also conducted a meeting with staff members and talked to them about supervision.

340:110-3-287(a) - Supervision. Supervision is the function of observing, overseeing, and guiding a child or group of children, including an awareness of, and responsibility for, the ongoing activity of each child, and being near enough to intervene when needed. The program is required to maintain supervision at all times.
